Yeah what was I thinking it's MUCH better to go to court spend a shitload of cash to get 1/4 of it back not to mention the aggrevation......

It's that Karma thing for each time you actually get nailed doing something wrong/stupid there's more than likely been 15>20 times you've gotten away with it.

Think I'd much rather live here in criminally founded Australia than the US where if you fart at the wrong time you'll be sued...

What about small claims court? Doesn't cost much and no lawyers are needed. Take lots of pictures and an estimate to get it fixed. Look at their 4runner and see if there is damage to the bumper and get pics of that as well. Be ready to own up to being impatient and passing illegally and take the police report (if the cops filed one).

If that fails, put up some flyers with her picture and the 4runners to give the neighbors a warning :biglaugh:

Small claims is exactly the court this would belong in...and its pretty much free. No lawyers, takes one day off work to do it. Is that worth trying to get his shit paid for by the person responsible for it? hell yeah it is.

so your saying that because he passed on a double yellow, he deserved to get his car wrecked by some phycho driver that chased him down and hit him long after the passing took place? And what about her Karma? Maybe she has been pushing her luck terrorizing other drivers and this is the time AND the place for her to get hers sorted out. Maybe she needs to be stopped before HER anger behind the wheel gets someone killed. Or maybe its just someone else's responsibility to call her out on her actions, and he shouldnt "get involved"

haha thats pretty much what the cop said to me and i told him i wish there was more to explain...crazy story but i've disclosed everything that happened.

BTW got an estimate done today....$1500

In the letter, say that you have already filed a police report and you are ready to go to court.


Oh and one more thing........... why did you tell the cops that you crossed a double yellow line? You should have just said that you never saw her car before you noticed that the car was following you. There's no proof of you "crossing a double yellow line and cutting her off" besides the word of a person who hit-and-run.

because if i just told the cops "some crazy lady hit me" and they found out from her i passed on a double yellow, i would lose credibility, better to spill my guts all at once. not like they can prosicute me for it. if i went up to a cop and said "I shot 4 people yesterday" he couldn't arrest me for ADW.

The law doesn't work like that.

You can prove that she did a hit-&-run while she can't prove that you passed her via double yellow line.

so your story should have been something like...

You were driving along and this car started tailing you. You noticed they were following you around and you stopped to find out what they wanted, then they hit you and ran off. (or whatever the real story was AFTER you passed her)

Then when she brings up the "you passed her" thing in court, just say you never saw her car before and you never did that illegal pass.

Yeah, that's lying, but it will work. That's how the court system works here. You could have got your way if you had never said anything about you passing her.

Besides I find it's best to only volunteer information that helps your case...kind of a "dont ask, dont tell" policy in legal matters.

oh sorry. i agree with you IJ. it would be stupid to take this to court. unless you want to spend money to prove something to her only to have it backfire. i dont have any faith in any judicial system, canadian, american or otherwise. I'm just saying it wouldnt be instantly thrown out on the grounds of him commiting a traffic offence. what she did was wrong, and if he so chooses he can and will be able to get the monetary damages she caused. although, i'm pretty sure you'd want to go through your insurance company as you KNOW who it was. the police decided they didnt want to charge her with a hit and run... so clearly she won't be facing the criminal charges.

Personally, i would of lied a little like posted above to get what i want. then ill give it about 2 months and then get a crow bar, and pry all the door handles to where she cant open the doors, then break every window that car has, then ill get on top of the car and take a huge ass turd nugget with a little note that says, "this is wat ur worth" :D but then again thats me i unno bout u lol.

I'm not condoning what she did in the slightest and if it were my car she'd be paying for a LONG time to come I'm just saying fight it in court and he'll lose NOT that it will get thrown out.

I also advise having some patience before it comes time for her payment and be smart and tell no one and don't post anything about it.

In the current world climate Young Guy Fast Car = lose in court unless you have older respectable witnesses......

It sucks but this is the way it is and sometimes you just have to cop it sweet then sort it later to you satisfaction.

(Trust me I got royally screwed by the system after my accident so I have a clue how it will go down)

I disagree with you naysayers entirely. I have quite a bit of experience in court. First of all were talking about a civil matter if he takes it small claims court. We are not trying to prove whether or not a crime was commited. Were trying to prove whether she is financially responsible for his damages or not. The fact that some time prior to her ramming his car he commited a traffic offence is completely and totally irrelevant! Look at it this way, if I was spinning donuts in the street in front of your house and you walked out and shot me because you didnt like it...do you think the judge would say to me..."well you were being an idiot, you got what you deserved"? Hell no, they would not only throw you in jail for ADW, I would be able to hold you financially responsible for my injuries. This is no different. Her vehicle is a deadly weapon when used as a battering ram.

But like I said, hes not trying to get her on a criminal charge, hes trying to prove her responsibility. It has a much lower burden of proof than a criminal matter (look at OJ Simpson if you want a high profile case that illustrates the difference)


He has a witness, a second person riding in the car. She has nothing. He has damage to his car, she probably has evidence on her car that incriminates her. I also think your being kinda cynical about his age. If he goes into court well dressed and speaks well for himself, I really dont believe a judge is gonna hold his age against him. Age and maturity, might speak for his charactor in either a negative or positive way...thats up to how he cunducts himself. Besides if he has good evidence, it will speak for itself.

Go get pictures of her 4runner...try to get some that show her damage, and corraberates your story. Document your own damages with pictures. Write out a timeline of the events, now while its still fresh in your mind. Have you freind who was riding with you do the same (but not with you watching, have him write out his own version of the story...then later compare the two stories and look for inconsistancies. Doing all that will help your case in court.


Listen guys, I know some of you think he should just forget it, and maybe thats the best thing in the end, but let me ask you this...if you were being stupid and left your wallet sitting on a bar and you watched some guy take $1500 dollars out of it...do you think your attitude would be...oh well, I was being stupid I deserved to lose $1500?

Im sorry but the law just doesnt work that way. It is designed to protect the stupid just as much as the rest of us. Have you ever heard of cases where criminals were awarded large sums of money for injuries they sustained while commiting a crime? It can and has happened. Fortunately, as of late the courts have seen fit to stop this practice...however, bear in mind that a traffic infraction is not a crime, it falls well below that of even a misdemeanor.

I just recently got back at a guy in a light blue Exploder who went crazy on me for "cutting him off." Even tho he was about 10 feet behind me and I used my signal. He flashed one of those fake badge things at me, the ones you get if your family or a friend is a cop (i know because i have one), and threated to give me a ticket and all that. So its been almost a year, I found out he lives in my neighborhood a little whlile ago. So my revenge was to buy 6 dozen frosted donuts from D&D and put them all over his car.
