here is an update,

i went to the court today and i told them that i called the ref but an automated message saying that do to the state buget....blah blah blah....(1-800-622-7733)..and everybody behind the counter were scratching there heads. they said "how stupid can the CHP (california highway patrol) be and tell you to call a dead end number.
they then advised me to call the CHP and tell them about phone number being a dead end.

i want to make an honest effort first of fixing this problem. if worst comes to worst im moving to texas with my cousins. any one know how strict they are over there?

to answer some peoples questions, i have a 3 inch canon style Megan muffler with chrome piping following behind it. ive considered painting it black to match the bottom of my car and getting a 3 inch dual tip muffler that looks stock. the only stock looking one that i can think of is the HKS. anyone else know of any other muffler that looks stock-ish?

Woot! Another 'free legal advice from people who don't know what they're talking about and don't care to even give it a half assed attempt to look it up' thread!!! <grabs popcorn>

I'll save you all from the three page post I'd written... here's a synopsis:

Out of state commuters who spend a certain amount of time in CA are actually REQUIRED to register their vehicle in CA (section 4303). You just don't get plates. Now if this entails a full inspection or not I don't know, but I can't find anything about an exemption so you're better off assuming it does.

You do not have to give permission to search you car... you think the bureaucrats are hated by people because they like giving us loopholes out of everything? ROFL, right. If you haven't signed off giving them the right to search your vehicle at the officer's discretion when you took delivery of your license or registration it's no biggie. If I read it right, any law enforcement officer in CA may inspect your vehicle under the CA Vehicle Code, sections 2804 and 2806. Those only state they must suspect the vehicle of being operated out of it's designed capacity or in an unsafe condition.... I'm sure there are more codes I didn't see that cover every other situation.

Engine swaps are legal in CA. But, they've got enough other stuff tucked neatly away in other related laws to nail you to the wall without you ever seeing it coming. The engine has to come from the same class of vehicle, the engine has to have ALL of the emissions, induction and engine components that were included on the original USDM engine (gets very vague if it's an import... probably just another way for them to nail you). If there was something special about the gas tank you probably better have swapped it. Additionally, it doesn't matter if you bought the car with that engine or not. Ignorance is no excuse. It's still entirely your responsibility to ensure your vehicle meets the requirements of federal, state, county and city regulations.

As with any laws, the laws under discussion here are regulated by the state. Just because something's legal in yours doesn't mean it is legal in another.

Basic common sense, if you think you've found a way out from reading through the local legal codes... more often than not it's just because you haven't really understood what you just read.

I don't presume any of this to be 100% accurate, nor do I guarantee the accuracy of my own interpretation of what I've found. I will tell you this though. I'm far less likely to piss off a cop, ref or judge by not presuming to know the law better than they do. ;)

If you don't know, ask a lawyer.

ok, gave the CHP office a call. stupid people want me to ask for an extension on court date until the refs are given back there jobs. i highly dont think it will be anytime within the next few years because of the fires in east central california. (spent 13 million dollars day because of it).

" your honor, i would like to ask for an extension of 2 years because california is poor...." no..i dont think so...ill go to court and ask for a fine. like i said though, if that doesnt work i would love to move to tex-ass....

Move to TX or not... they can still require you to get your ass back to CA for another court appearance if you don't satisfy your current obligations. Or, they can have you shipped back. It's not over until they say it is. ;) Wish I had that kind of freaky powah!

EDIT: I sure as hell hope they've got some sort of limit as to how long they can make you wait. Perhaps you can talk them into letting a Toyota mechanic sign an affidavit. ;) (Of course that'd only work once and you had better hope he'd be on your side, because you know they're going to choose who. It is better than nothing though.)

I have a better idea vs walking in and asking for a fine ;)

- Show up at your court date...don't do their job for them
- Bring proof you tried to comply with the requirement to see a state ref
- To the best of your knowledge your motor is emissions legal in the state of CA

I thought police had to have a warrent to search your car without your permission. Doesn't looking under the hood count as searching? Or is this a different situation because it's about car mods? Still doesn't make sense to me, oh well.

Best of luck with keeping the fines low!

2 weeks ago i recieved my "1jz tt" plates in hollywood DMV and it did help with integras behind me- they just follow very slowly and peacefully. But, man, i'm scared to drive now, from what i know BOVs vented into atmosphere are also illegal in California. But, again, i see right-hand drive silvias almost 2 or 3 times a month in LA. You just got so unlucky ,dude, or maybe we will start hearting these strories more and more now. I wish there was someone from the police on the inside to let us now if there is something going on on a larger scale, i really doubt that a cop would care enough to know the difference between 7m and 2jz without a special training or instructions what to look for.

LOL I wanna see that cops face after finding a golf bag or what ever you have under your hood.

let me get this straight.

They know what a 2jz is from a 7m and yet they won't know that an MR2 has a rear engine configuration?

You guys are smoking something fierce!

Figgie, not 'they' - this one officer in particular. I SERIOUSLY doubt California is spending the money to educate officers on all the various engines/chassis configurations available ;)

They dont know. Cops know everything about 240s and the such here. They look at an MR2 like its from space.

In my area its more lenient. I got speeding tickets(and snuck my way out of them) in my blue supra all the time, never once had to pop the hood.

down in LA where everyone is a ricer, the cops are more knowledgeable
