My first speeding ticket, anyone have info on the trial?

Hey guys.

I just got my first ticket ever. I was in my integra just got off the highway after a 60 mile drive back to my school. I saw the Undercover on the side of the road.

I wasn't flying or really going fast at all.

pulled me over for doing 40 in a 30... Obviously that's a perfectly ticketable offence, but I am confused as to what to do when I plea not guilty and get a court date.

The officer was nice and didn't get me for my tints, loud exhaust, or loud system ( I was in the tegra).

He said "If you plea not guilty I'll try to take care of you maybe get you a seatbelt."

I suppose he means he will make the plea to a not wearing seat belt charge.

This happened in New York, West Harrison County.

Any advice for the court would be extremely helpful, as I don't work and have no clue how I will pay for the ticket!

40 in a 30.... DAMNIT!

He was giving you a brake on the seatbelt ticket. But if you fight it or plea not guilty and have a trial he will tack on/ add that charge also, is what he was saying. It makes people not fight their ticket as much.

Here is what I did to stop getting tickets
<-----quit speeding!! After I had to sit in Jail for a week because of a speeding ticket. Lesson learned

Plead guilty and go to traffic school. It wont affect your insurance, no points will be lost. Only some time will be wasted.

or

Plead not guilty, get the second date, go tell your side of the story. If your lucky the cop wont come back and the charges will be dismissed. In this case the cop sounds like he will come back and then you might get an additional charge. Plus even more time will be wasted along with money if the cop shows up.
 
Why would I get an additional charge? i think he was saying he would plea it down to a seatbelt charge and not the speeding. I definitely had my seatbelt on, didnt even take it off to get to my reg and such.

and I don't really speed, my speedo is a lil off so i didnt realize i was going 40....

i am just confused, and really hope my insurance doesn't get messed with.

I have only been pulled over 2x in the past and it was cuz I was in a drug infested area, so they just pulled me over searched my car and let me off both times.

I love how your title is "170mph club" and u said u quit speeding LOLOL

Or ask for a mitigation hearing. A mitigation hearing is basically you admitting to the charge, telling the judge you won't be back in their courtroom again for the same thing, and he/she will lessen your charge. (Monetarily)

Sorry I miss understood what you were saying in the OP. Then yep the cop could reduce the charge, but normaly they just write the ticket for the seatbelt and not the speed. But since you had it on then I dont know what he ment by it. A seatbelt ticket wont affect your insurance but a speed will.

You could try to and plea a "guilty with explanation" and try to the judge your story about the speedo being off, but still you are still telling the judge that you knew you were speeding by telling him you knew it was off and probably wouldn't get you too far.

You could always call the sheriff and ask if you could speak with "officer XXX" or use his badge #, and ask him to explain it more. They normally carry a department cell phone when on duty, and the dispatcher can patch you threu to him if he is working.

LOL on my 170 club ;)

And you didn't sue? That's a pre-text stop, an unlawful detainment, and an illegal search. I doubt they pulled you over because of the area you were in. I patrol the worst part of town, and I don't pull over random people because of where they are. I would get my ass sued, and then fired for doing that.

Dunkel, maybe he forgot to use his turn signal, had a burnt out light some where on his car or some or something else "not major". That give them reason to pull him over.

Next, since he knew he was in a bad area, maybe he was acting "suspicious" because he got pulled over in a bad area, and was nervous because it was the first or second time being pulled over. And BAM! that is all the peace officer needs to pull you over and "ask" if he minds if he searchs your vehicle. If he would have said "no you can't search it" the cop would have had a warrent issued ASAP and he would be out more then just his time ;)

Im guessing from your statement "I patrol the worst part of town" you are or were a peace officer, so you know how it works. Sorry, I drill my brother with questions like this all the time and wow the stories he has is awesome. (He is a officer for the city of Albert Lea)

Don't just pay the fine, get defensive driving, or probation...

Neither will go on your record, just paying the fine will

It was a 1 way street i was parked on the right the cop pulled up behind me, all lights off and stopped. I moved up cuz i thought maybe it was the person who lived at the house I was in front of. Lights went on.

"So you saw me come and you moved up? please get out of the car, there have been drug deals going on all day here sir"

I just did as they said cuz I had nothing to hide, and he just said "This is a bad area don't sit around here"

I was just waiting for my friend to come out from his house, which he just moved to.

4 more cars came went through my cabin a bit made fun of me for being a Pro Wrestler who attends college and they all left.

this was in Bergen County NJ.

The same day but earlier on the street next to it, the cop said my tail light was out, but it wasn't just said for me to leave the car and looked around, no fix it ticket, or anything so obviously he was just trying to look inside my car.


But to the speeding ticket, in NY I am told the seatbelt ticket is about 90 and the 40 in a 30 is about 100. this is what I am being told, so I am not sure if I should just eat the ticket and pay, or plea not guilty.

being 10mph over, it should not go on your license or reported to your insurance, i would just go, plea guilty and pay the fine, you may even be able to call up and pay the fine earlier.... do not waste your nolow on this small of a ticket!!!! you only get 1 per 5 years... and you never know when the long arm of the law is gonna find you speeding faster and you need something like it

on a higher than 15mph over you would want to fight it... but this is not worth the trouble... pay it and slow down :p


edit: a $100 fine is cheap!!! pay it....

Usually you can't do defensive driving for anything over 15 over...

plead not guilty, u will then go in front of the judge either the same day or they will assign u a date to come back. The judge will offer u a bargain if u accept a guilty plea hell dropped it down to a lesser charge or pay a fine and get no pts etc etc etc, or if u plead not guilty then it will go to trial.

Always plead not guilty, 95% of all cases in the U.S. ends in plea bargain and never really goes to trial, nobody wants to go to trial.

i just came from a court case i had today , wasnt traffic, criminal lol, but it was for some bullshyt and of course pleaded not guilty and the judge and i talked and it got he dismiss the charge.

always plead not guilty even if you are.

Alwaysssssssssss plead not guilty

What really matters is the points. Points are money for the long run.

Unless you hire a lawyer "your side" is irrelevant(don't). You can show up and hope the cop doesn't. You can work out a plea(unlikely) at the court date.

Me ? I would definitely show at court UNLESS I could just pay and get the points off. Sometimes you can show at court and get "adjudication withheld" so you pay the fine but no points because there's no admission of wrongdoing.

You see, chances are it won't be your last ticket so plan ahead because saying "slow down" doesn't apply in a society where the police have quotas to make. You are their "sale".

First time offenders get to do traffic school here. No points, nothing goes on your record, and your insurance rates don't go up. You pay court cost +1 hour traffic school. Cops here love to go to court, they get the day off and get paied to do so.

Lets face it, you know you were speeding, the officer knows you were speeding as well as not wearing your belt and having some equipment violations. Don't go to court over it, too many people get outta tickets and other stuff with thier lawyers and bogus arguements, I have no respect for people like that, take your licks and move on don't be yet another spoiled self centered scam artist POS like a lot of people out there try to be.
