Adam, I think you're making a mistake. Sometimes people get screwed by insurance but it seems like you're cutting the middle man out and doing that to yourself. If he's admitted fault, there's no reason not to go through insurance.

There is no reason not to go through insurance except for the person at fault (him) not wanting his own premiums to go up. If that is the case, get a quote from a bodyshop, and get him to pay you that amount, if he does not want to pay that much, talk to the insurance company.

(Laws vary from state to state, province to province, but I've never heard of at-fault insurance. That is a ridiculous proposal. As far as police reports go, here in Alberta you need one if the damage exceeds $1000.00).

It wouldn't matter if you were speeding, he still would have hit you. He ran the stop sign and hit you. 100% his fault. Make him pay way more than that or hit up his insurance company.

Colorado used to be a no-fault state where if you were in an accident, both parties suffered with their insurance companies. Accidents were a bad thing, almost no matter who was at fault. I think the idea was that you should be a "defensive" driver or some bull-shit.


In an accident, under no fault laws, your auto insurance company will pay for your damages (up to your policy limits), regardless of who was at fault for the accident. Any other drivers involved will be covered by their auto insurance policies.

Your insurance company has to pay for damages to your vehicle, with the exception of severe cases (i.e. drunk driving, extreme speeding, etc..). So unless you get hit by someone doing much more than simply not paying attention, you'll be penalized through your insurance company.

I think No-fault is fucking stupid and I'm glad Colorado is no longer using that policy.

Sorry to hear about the '87. Hope it gets mended correctly.

^^^^^^^ That's why I'm not going through the insurance companies. Thanks to the No-Fault law here in Oregon, my insurance rates would go up even though I was not at fault. A replacement door and fender isn't much, and I don't care about getting it repainted to match since my new welder (just bought it yesterday) is going to be put to use shortly to remove the side trim and once the side trim is gone, the whole car is getting prepped for paint 1 section at a time (doing the roof is going to suck big time).

Yeah, no-fault blows big time. I'm just glad he missed everything and that the Supra really is a tank (his car faired much worse).

Atleast I can get a replacement fender and door for cheap. And atleast I am going to repaint my car shortly anyways (once all the massive prep work is done).

Might what to get that looked at by a professional before making any rash decision to not inform your insurance company.

Accident damage nearly always tend to be worse than it looks - It's very possible that you're looking at more than a replacement door and fender.

Either way, good luck.

Hah, wow and I thought TX was bad about insurance. Only gay thing we have [which im sure is the same in many other states] is that any damage on the back of the car is the car in the backs fault, pretty much no matter what. Unless the other person admits that it was their fault, but dont think anyone would do that.
