Funny thing is I believe we are being targeted. I live in largo florida and we have our share of redneck modified trucks, that are WAY too loud. They do not have the factory exhaust on them however the first time I get pulled over one of these super loud redneck trucks go by, I ask if that is also illegal. Cop actually said "no thats a truck" ! Like trucks can be as loud as they want to be! Well my fathers supra is 100% stock I need to do a DB test on the stock then on my turbo sn see how diffrent we are.

wrong answer

see the statue i posted

316.293(5a& 5b) broken by making it louder than OEM. This means that anything BUT OEM is a money making machine for the state. And you Florida boys thought the tourist would support the state budget! HAHAHA!!

actually you are wrong. i beat this exact ticket by simply proving there was no DB test done to my car when the ticket was written. the law is simply no modification can be done to your exhaust that changes the noise level. how do they

a) know what the stock DB level of a 90 toyota supra exhaust?
b) know that yours is louder WITHOUT taking a db test.

it doesnt fly.

they can write the ticket but if they dont do a test it will get thrown out just like mine did. HOWEVER IF THEY DO DO A DB TEST YOU CAN STILL GET OUT OF IT. as i stated bring up the fact that

a) they dont know that it IS NOT STOCK OEM equipment
b) do they have the DB level of the 90 toyota supra oem exhaust? DOUBT IT...therefore they CANNOT say its louder.

its another joke law that only asshole cops enforce but it can be gotten out of easily.

This is copied from a friend of mine who has a way you can get out of it no matter what, although depending on how big a dick the cop is you may have to do it in court:

Note GPD= Gainesville Police Department
ASO= Alachua county Sheriff's Office

^These are the local "law" enforcers.

Steps to take when getting pulled over (and consequently being interrogated about noise and exhausts).

1) Do NOT admit to ANYTHING. Just say, "I don't know."

2) If asked, state that you know nothing about a modified exhaust, and tell them that you purchased the car like that. "It's stock as far as I know officer."

3) Do not give in to any questions about how loud the vehicle is. Just state that you believe the sound to be no louder than stock AND as far as you know, it is STOCK and not modified.

4) Ask for a WARNING! At least you can wipe your ass with them, or simply use them to check the oil on your dipstick.

5) If you still receive a citation, PM me and I will refer you to the Legal offices of Brown, Browner and Clapptontranscripts - Charlatans at Law.

*edit* - ASO is mainly doing exhaust citations, whle GPD is doing stereo citations

We touched on this before, in Clappton and TwoBar's posts, but now it seems GPD has a unique task force assembled to serve and protect the ears of those crybaby civilians that complain about noise. What a bunch of fucking bullshit. For every sportscar out there in Gainesville, there are 6 trucks and a pair of Harley's that blatantly violate these statutes. And sometimes the pigs themselves are the ones operating these loud vehicles!

I've personally witnessed a guy in a white 300ZX getting pulled over right next to me downtown for a stereo violation (25 feet). The pig was sitting in the dark in his cruiser, and violently floored it out of the lot with lights and sirens, as if he was in hot pursuit of the Blues Brothers. Apparently the pigs have been "trained" to figure out what a sound violation is.

Anyway, I urge each and every one of you to fight these tickets in court. The pigs are not doing dB meter inspections, in almost all cases.

They must provide documentation as to what the decibel level and equipment was on the stock vehicle, as well as what recorded dB level they obtained when pulling you over.

One other thing, I don't usually believe that cops profile imports, but I have been hearing about several import cars that are getting the modified exhaust tickets more than other cars/trucks. Can anyone substantiate this claim? Has anyone you've known gotten an exhaust ticket on a domestic or a truck?

Everyone please spread the word and encourage everyone to fight these tickets. Also post up any concrete relevant info that you have personally experienced / heard

Thanks for the tip, i got pulled over once n the cop let me go cuz the car was not in my name, i have 4'' goliath that is super load . BUT i must say its funny because right now i am running open down pipe and i've been driving it this way for some time now and no cop as of yet has pulled me over.

HPF Goliath
Int dia: 3.87
Weight: 21lb's any where from 22 to 30 lb's when shipped. 21lb's! WAY LIGHT for a 4'' exhaust!
dB at idle at 10 ft: 84 dB
dB at 6000rpm at 10 ft: 101 dB
dB at idle inside car: 75 dB
at 6000rpm inside car: 90 dB

i rarely go WOT so its cool

they know it's under 95 db ;)

not necessarily...not to mention a stock exhaust from almost 20 years ago could be easily rusted through and sound like an open dp.... this "law" has so many loopholes its not even funny.

besides...if they didnt take a db test of the aftermarket one then how do they know its NOT the same?

I love these modified exhaust laws that say anything other than stock is illegal.

I'm lucky here as there is VERY little rust, but I'm sure a lot of people have had their exhaust literally rust off long ago on many cars. This is why exhaust shops exist! So now my non-stock exhaust is illegal? Ok, that's fine, go fine them for making it...

LOL. Reminds me of getting pulled over for having a chrome tip on my exhaust. I talked to the Sgt, at the state patrol office and he told me to ignore the fix it ticket, and that he would have a talk with the rookie trooper.

well if i were to take Ideals post at face value.

Then we have idiots that pass arbitrary grey laws just for the sake off killing trees.

Ideal

what exactly was the statue they gave you the citation?

If it was a noise violation, then your court apperance had ZERO to do with 316.293(5a& 5b) but instead has everything to do with 316.272 which is exclusive but can be added to a 316.293 violation.

316.293 has ZERO to do with noise.. at all. So consider yourself lucky that was not what was written on the ticket.

(b) No person shall operate a motor vehicle upon the highways of the state with an exhaust system or noise-abatement device so modified.

I posted without reading the very statute I posted.

316.293 is inclusive of both noise and muffler modification.

when they cite you they do not throw the entire statute your way.

They are specific.

316.293(2)
or
316.293(5a)
316.293(5b)

they will "itemize" what the infractions were on the ticket.

I got the same ticket last summer for my Blitz nurpec exhaust for being too loud. You have two options. Pay the fine, which is like $40 or have the ticket sign off by another office and pay the fine whic is like $10. The officer that signed off on my ticket didn't even take a look at my car. He was suppose to inspect my vehicle to make sure that the silencer was install and the noise level was down to stock oem. I guess he was kinda busy with his donut.

Hell I love canada. I have tinted side windows, havent been bothered yet about them (35% tint). I used to have tinted taillights, I never got bothered about them. I passed 3 or 4 cops before when I had no muffler at all. I used to have no tag lights... etc.

Cops here usually have something more important to do. Ive never been pulled over for no reason at all in my supra.. Or pulled over at all for that matter.:icon_bigg

This is a tough issue because on one hand, a really loud car is obnoxious.

On the other hand, there are too many stupid laws designed to protect ourselves from ourselves.

Personal responsibility, much like morality or common sense, is impossible to legislate and even harder to enforce.

Oregon liscense plates registered in an area with no emission testing + driving in southern California with no silencer or cat = untouchable except for noise violation in neighborhoods.

I hate these stupid laws. I vote that so long as the vehicle is safe, passes emissions out the tail pipe, and is quiet enough, the vehicle should pass. Hell, my 1J can pass SoCal emission testing, but will fail on the fact that the motor is "illegal". Whatever. Car laws in almost all states suck balls.
