so i got home yesturday ( i live in an apartment complex) and was dropped off by my supra...or lack there of.....i was scared out of my mind...called 911 to report it stolen, and it turns out it was "parked illegally" i was in MY parking spot, straight, so i called the tow truck company to figure out why......they said the apartment complex had it towed because my tag expired 3 days ago.....and they wasnt me to pay an arm and a leg to get my car back.....is this legal? i didnt get any letter or warning from them.....

if your tag was expired than yes its legal for the apartment complex to call and have it towed they prolly have a account with the towing company for just that reason.

if you dont pay it they will keep your car or auction it off my familys been into towing for 35-40 years it happens all the time we've kept some pretty nice cars because of it.

Um, since when does an apartment complex have the authority to enforce the law? At the very least you were owed a warning.

Unfortunately there's probably nothing you can do but pay up, so I would raise mega hell with the management and do anything in my power to make sure they pay somehow - post up on the internet and make sure they know it, get word out to your neighbors, anything you can do to make them regret being such dicks without making your neighbors miserable or justifying eviction. I'm irritated just hearing about this.

Two points:

1. Being within your rights and doing right can be two vastly different things. The building management were assholes regardless of their rights.

2. Returning the favor would certainly be within toogoode's rights so long as he didn't become an nuisance to his neighbors or break the law. Hey, you reap what you sow, right? ;)

Unless there have already been problems between toogoode and the management, I am at a complete loss to understand what they would hope to gain by doing this. Anybody got any ideas?

im not sayin they werent assholes about it and yea they acted very fast on it but they prolly have a PPI account with that towing company and get it for cheap so it prolly doesnt hurt them alot to get the car out of there if they want it gone.

if he wants the car back (which im sure he does) he needs to get the money ASAP because impound fees will keep building up until he pays them.

their prolly not gaining anything, it might be in his lease that he cant park unregistered or unfit vechiles in the parking lot. Alot of places are like that.

Yea, they have the right to do pretty much anything with their property. I'm sure it says everything in the small print that usually never gets read.

i read the contact and was supposed to be given a 24hr. notice....my dad has owned apartments for the past few years and said that he would usually mark the cars 2-3 times before they were moved....i just fucking got that supra a week ago.....management will suffer if i do not get my car back. fuck it, ill tow their fucking cars with my buddy's repo truck.....but seriously, im just disgusted with my apartment complex now.....ive always payed rent early, and never had the music up.....

It maybe just the towing company drivers themselves driving around and towing cars that meet the criteria. Some apartments have the rules in the agreement about parking only registered vehicles on the property.

Where I lived, they were once towing cars illegally and got busted. My Scirocco was once towed from my spot. My apartment manager said she never called them and she said I was parked in my assigned spot. So she made them bring my car back to my apartment for no cost.Good thing is, they can't tow cars here without notifying the police... :)

You probably have to look at your contract. It may state in there about registered cars.and the longer you wait to get your car out, the more you will pay.

If it were me, I'd pay to get the car back today because now you owe the tow company and everyday storage stacks up.

Read your lease. If you can't find where they had the authority to remove your car from the premise, then you present your information to them and ask them to point it out in the lease where is states where you where in violation.

If they can't, and won't make it right, then the next step is to have an attorney draft a letter on your behalf stating your case and demands. I'm not a lawyer, but it seems to me that someone is in breach of contract here or non compliance to something.... words...

If you cannot get a resolution to your satisfaction, start looking for new place to live.

Experience is something you get right after you needed it..... Getting screwed is well, still getting screwed.

Yep, drivers are paid per tow. They spend their evenings looking for vehicles that meet the requirements. I doubt the apartment complex had anything to do with it other than signing the agreement with the tow company.
