Insurance settlement too low?

id say thats way to low. I was in truck that was rear ended, and the first offer they made me was $2500 + my weeks lost wages. Id say hold out for more. especally if you dont need the money right away.

I recommend not settling until your physical therapy has been taken care of and you can quantify the amount of time (lost wages, rental car, etc anything else resulting form this accident that you have not been compensated for) and effort spent on going to therapy. You are entitled to pain and suffering as a victim of an accident. If necessary you have up to two years (and not a day more) to sue for compensation for your loss.

The amount you get paid for pain and suffering is most likely an amount that the insurance company feels is comparable to what they have paid out in accidents in similar circumstances. If you feel their offer is unfair and want more your only other option is to sue.

I think we all agree that you should never have to pay for the privilege of being in an accident, but in the same way you should never be paid for being in one. You should be compensated for what ever time you and your mom had missed off of work, and that's it.

$10,000 certainly isn't going to make the pain go away any better than $1,100 will.

Aren't you the guy that was exposed as a car thief?

Define your 'pain and suffering,' please. You say you've been in physical therapy and seeing a chiropractor, but you haven't really told us anything. What was the estimated speed of impact? What actual injuries did you receive? How has your lifestyle changed?


On a side note, never go to a chiropractor. Once you start seeing one, you usually can never stop (sure, you'll feel better after that visit, but then you'll feel even worse when you don't go)

The problem with pain and suffering compensation is its all subjective. When I had my bike accident my laywer told me to expect $100k for every time they took a scalpel to me (twice in my case). The numbers you gave seem a bit low to me as well, but I also hate to see people try to get greedy. Try to decide on a number that makes you feel compensated for what you went through and try to get that.

Thats the best advice I can offer.
