has anyone got any suggestions on how i can deal with this guy?

bought a couple of gameboy games from ebay
cost $56usd for both of them
paid through paypal
got them in the mail
open them up and start playing one... save.. turn off... turn on later... "your save file is corrupted"
huh??? goes to google to see if this has happened before... ppl keep talking about bootlegs (heh they're friggin trousers here)
do more research
find that are fake fraudulent copies counterfiets :(

only realise later on reading the auction again... they are imported from another country but he is located in the UK
on the packaging i receive in the "from" section is the supposed UK traders name but coming from pakistan!

first email to trader
hey

i got the games this morning... and unfortunately they appear to be copies and not the original item... they have a fault on saving and once undergoing research have discovered they are fakes

the other thing that gives this away.....
on the box it says copyright 2002 "intendo" which i highly doubt they would mispell their own name :(

I am going to see my local Nintendo agent to verify my findings tomorrow

Could you please let me know how we can remedy this

Thank you

reply from trader
Hello thanks for the email,

I got the games from suppliers in Pakistan, they advised that the games were of original condition, I have no clue about this.

to trader:
Well.. the only solution i can think of is this

You refund the money i paid for the games and i can send the games back to you... and you can test them in a gameboy of your choice and verify this
I will still leave good feedback being that i paid and you still sent in a timely manner

how does that sound?

reply from trader
Hey sounds good,

But I can only refund you once i receive the games back in the same condition it were sent to you, please send the games back at the following address:-

15-C-III
GULBERG 3
LAHORE
PAKISTAN

reply to trader:
Realistically... these games are my only gaurantee that you will refund me
If i send them... there i have no gaurantee you will ever refund my money and being that i am on the other side of the world doesn't help

I hope you can see my point of view

Dear Customer,

Many thanks for your email, we are dealing in trade business and hence in the trade industry there are no refunds offered unless the original product is returned back in good condition. You live in New Zealand and you would probably know that you cant get a refund unless you return the product, you cant ask the shopkeeper to give you the refund without giving him the product back. Apart from all this My add clearly stated that the games were import and come without instruction manuals, I have had no complaints about these games soo far from the customers who have purchased them off me, and you are the first one. Also you should consider the amount youve spent in purchasing these items and you wouldnt have been able to get them at the same price if you went out to the stores or to your local nintendo dealer. I have my options open for you to either reparcel the games back so I can refund you or you should keep them.

Regards,
Varietysalesman

I will send you one game back with the original packing and await your refund, upon refund i shall immediately send the other one

how hard is it to get money back usually?

Weigh out your loss's and dont buy from ebay unless you know exactly what your buying into??

lemme guess he was selling alot of the same copys of the games, just like if you search headlights it shows 1 seller selling 1500 of the same headlights for 10 millions different cars lol. There crap crap crap, I learned my lession with the headlights and fog lights haha... im sure many people have with other items.

as far as getting money back, I doubt it, Unless you contact nintendo and say look, im sure there is a law agaist copywriting games.. of course and a big ass fine. Explain your situatyion with them so he can get sued and in the long run your 56$ could turn into 56000$ for him lol.

and im sure you can get a peice in on this for agervation fee's, doctor up the emails and say he said he was gonna cut you up if you said anything then you can sue him for communicating theats... or or or!!! you could say you had his baby and hes not paying child support.... or you can ignore the last paragraph where it started going off course and do everything the before paragraghs stated lol.

O screw this bastard, he knows damn well they are counterfit, Nintindo will deal with this SOB, take it up with them, and he wont be selling fake crap ne more and you prolly will be rewarded. or at least get your $56 back. game companies love people to tell them where and who is selling counterfits, %99 of the time they will be reasonable and send you legit copies of the game for your trouble and then go after the person who is doing this.
if all else fails, and u feel scammed hit up paypal now while he still has some money in his account, cause i bought something for $30(yea i know not a whole lot but) and it was fucked, so i hit up paypal, and they only got meback $10 of the 30, because the guy took the cash out of his account, which is some BS.

File a complaint with everyone you can think of that may have any jurisdiction in this situation (anyone who handles international fraud, software piracy etc). Notify Nintendo's offices there and ask for whoever handles software piracy and such and give them everything you have. Also notify Ebay and Paypal that this seller sent you pirated software. Also, put his seller name here (if allowed) so we can avoid them and maybe send some hell his way.

Yeah...file a complaint with paypal. If he has emptied his paypal account then paypal would not be able to extract the money from his account.

And call Nintendo and give them all his details. Let them find that prick and sue his pants off.

Cheers,
Roy

Suze: I can see his point about not sending a refund till he has the goods back, he'll probably refund just so he doesn't get a bad feedback as word of mouth online is a powerful deterrent.

If you paid with a credit card on paypal, contact them as well.
Contact nintendo
Ask nintendo who else can you contact.

If you purchased from somebody in the UK, you may be able to contact authorities in the UK?

Good luck.
