Man Awarded $8.6 Million After Crashing Into Pigs


A Monterey County jury has ordered the state to pay $8.6 million to a motorcyclist who was severely injured when he struck six wild boars on a state highway in 2003.

The jury ruled Friday that the state was responsible for Adam Rogers' injuries because officials knew that wild pigs regularly crossing a stretch of Highway 1 just south of the Carmel River were creating a dangerous situation, but they did nothing to address it.

Rogers, a 45-year-old former karate teacher and champion kickboxer, suffered serious injuries and is now confined to a wheelchair. He and his wife sued the state Department of Transportation in Monterey County Superior Court.

DOT attorneys argued that the state wasn't responsible for the actions of wild animals and said Rogers was under the influence when he struck them. A test found Rogers had a blood-alcohol level of more than .10 after the crash, but the jury concluded that wasn't a major factor in the crash.

Rogers' attorney, Larry Biegel, argued that the state knew the pigs were crossing the road to feed on vegetation in a nearby environmental restoration project. The state later put up a pig-crossing sign and used hunters to help control the pig population.

"This was a situation that they, the state, created, and then once they created it and saw what was happening they did nothing to stop it," Biegel said Saturday.

Most of the $8.6 million award will go toward Rogers' medical bills. Biegel said Rogers requires around-the-clock care and won't walk again. He said he still suffers from gaps in memory as a result of massive head injuries he suffered when he was thrown from his motorcycle.

"This ensures a lifetime of medical treatment, which (Rogers) desperately needs," he said.

Rogers' wife, Kristin Finn, also was awarded $500,000 for "loss of consortium."

What the fuck, I guess we should all get drunk and crash our cars into deer and sue.

I feel bad for him and the family but still....wtf. People hit deer all the time around here......In fact one just totalled my supra a couple months ago....so should I go after the state for not doing anything about it???

I think it would be easier to marry some one dumb enough to ride a motorcycle drunk into some animals he prolly already knew crossed the road there and collect the $500,000 loss of consortium check :3d_frown:

Let's just be thankful the pigs stopped him before he could kill someones family. It's nice to finally see where the drunk driver is fucked up for life instead other people.

It's also a great example of dumbass jurors. They must've been ex O.J. jurors.

I recently was a juror on a case where a woman was suing a very well know restaurant chain for her life changing injuries. The lawyer for her proved that company of all types of ignorance, neglect, and showed me that they are run similar to our new government (with no idea how). But, as we went to deliberations, we were told if the plaintiff was at all a little bit negligent, we MUST side with the defense. The woman had tripped over a curb in the handicapped parking. She stated in the case, that she never looked down at the curb. We could not find in her favor over that. Now this piss poor run company smiles and keeps going, unpunished, while the poor little lady gets nothing. I didn't want to rule that way, but the law stated it, and most everybody in there agreed that is what the law was for. I felt that lawyer for her did a great job, but he missed that part of her coaching, and it cost them.

It does kind of piss me off that the pigs where there because of vegetation in a nearby environmental restoration project.
In my home town (SW Ohio) they cleaned up old Radium containing wastes from the Manhattan Project. (fernald) Turned it in to a wet land and banned deer hunting. Now people are killed in car crashes all the time because of the deer population. They can’t let anyone in to hunt because of the gamma rays. Don’t get me wrong I thank the gov. for cleaning up all the K-65 wastes that where in direct contact with our drinking water. But now it’s a breeding ground for thousands of deer. Sometimes they don’t understand or foresee the ramifications of everything they do.

Drive with due diligence and according to the conditions.

The road to the town where my parents live has a 90km/hr speed limit... I could easily do 160 the whole way and probably never be concerned about the vehicle handling it. However, that road is riddled with deer, moose, elk, and bears. Doing anything over 110 is suicide in some places becuase deer can seem to come from nowhere and appear right infront of you. Doing 90-110 is driving according to the conditions with due diligence, dispite if it's a cloudless summer day.

I've seen many, many animal courpses and debris from wrecked cars, on that road. It's not rocket science: go slower, watch for animals, react accordingly. I know plenty of people who've swerved off the road because a deer popped out of nowhere... rolled their cars, wrecked their cars, hit trees, power poles, or just smoked a deer head on. And the end conclusion in every case is that they were not driving according to the conditions or not paying attention.

Granted but read the bold, the guy was on a bike for one, and two his blood alcohol level was .10.

Driving a bike requires more concentration than driving a car, not to mention trying to drive while intoxicated. I have no sympathy for people who drive drunk.
