House Closing Today Need Advice!!!

We're closing on our house today and throughout the process our Attorney has been a prick, he's no help to us at all. He yelled at my Wife for something he had no idea about. We never get to speak to him, we're always speaking to his assistant, and man she is an idiot.

We did our last review yesterday of the house and the garbage in the garage still remains and a bunch of brick under the deck was never removed. All of this stuff was mentioned and agreed to be removed prior to closing. So my question is, what can I expect at closing today about these discrepencies? What can I do if the lawyer tries to make me sign documents in a hurry when I'm supposed to review anything before I sign?

Has anyone ever comes across something similar to this? Thanks for your help.

glad to see you found a house, too bad the lawyer sucks. if the only 2 things are that there is some trash in the garage and some bricks under the back deck, i would just clean it out myself (unless the garage was FULL of trash)

I guess it depends on how bad you want to move in. If all of that stuff was agreed to then dont sign the paperwork... You have it in writing right?

Yes I do have it in writing, but these sellers are not budging. All their stuff is still in the house and closing it today. I don't understand it at all.

I wouldnt sign a paper until that stuff was done, esp if it was in writing. It should get done pretty quickly if they really want to sell it. Just tell them you'll find another place with people who will hold up their end of the deal. If it's garbage-garbage, you could argue that it could possibly be a health hazard and you wanted it disposed of and the area checked out before you sign.

Or, ask them to write you a 'we owe' check to you for removing it yourself.

I'd be making them bend over backwards before I signed myself into $100k (or w/e) debt.

Well, that might not be practical if you want to close today. I don't think I've had a closing without at least a couple of issues. Many times the seller would be willing to write you a check to compensate you for the work not done. Just be fair about the amount. It is a horrible seller's market right now, so they need to do something to compensate you for what was already agreed upon.

^ Fair hell. You dont just go 'buy' a house and close the next day. Cleaning out a garage and under a deck, 2 days.... tops, right? If they wanted my money, it would be done or they would be paying dearly for it.

With the way the market is going today...sellers are having a hard time closing deals...i would push the issue..unless you are getting a phenomenal deal on the house. But honestly, if they won't keep up their end of tha bargain in whats in righting...how do u think they have upkept the house...for those things not in writing?

I'm not saying it shouldn't have been done, but sometimes having an attitude about things doesn't work in your favor. If the OP has time to burn, he can demand whatever he wants. Both of my house purchases had some issues, but I have my time to consider as well.

I work a lot of hours, and when I was ready for closing, my other house was sold. Now I could have made some UNFAIR demands, but that would have meant me spending money/time on a hotel. I don't have the time or inclination to deal with that shit.

Understand what I mean by FAIR. I did not say enough to cover it - I said FAIR. If the sellers failed to do something that was agreed upon, fair compensation would be what it would cost to pay somebody to do it and maybe a bit extra.

If you don't care if you close today, you can do whatever you want.

Kind of what I was getting at... It's not like he's asking them to put new drywall in. If he's OK paying good money for a house and getting shortchanged, maybe he's a better person than me. I myself would not sign anything until everything agreed upon was completed, or I was compensated for it very well.

It's like buying a new car but it's dirty from sitting outside and the dealer said they'd clean it. If they do, great, if they don't, it's a few hours (maybe) of your time and you'll know it was done right and maybe you'll see some things that you didn't notice at the dealership. However, I would want a check in return for the amount I would have paid to have them detail a car for me as well as a little for my time. It's basically the same thing, nothing mechanically wrong with the car, just some 'eye sores' that would make driving the car (moving in) a little easier.

Hey guys thank you for all your opinions and comments.

I closed Friday and everything went well. My attorney actually did a great job, he raised the garbage issue up to the seller and his attorney. The seller's attorney actually mentioned to his client that the premises must be "vacant and broomed swept clean". The seller is cheap and didn't want to fork over the $1000k in escrow for the garbage bin and labor to get rid of the construction mess in the garage and under the deck. So he decided to do it himself, oh well, whatever works.

What surprised me the most was the I was told I may be paying $16k-18k in closing cost. It took us about an hour just to get the figure right, we got the "no fee" mortgage from Bank of America. They cover only some fee's, I spent a total of $12,140.76 for closing cost. I was pretty happy about that as I wanted to save as much money as possible.

The seller is moving this coming Tuesday and I'm gonna do another walk through to make sure everything was done as agreed. When that is complete, the house will now be mine.

Also, I actually walked with my laptop in the closing and surfed SM and SF, so thank you guys for all your help.
