Fuck over again by the police

wow just got back from court.

awhile back i was driving from my chicks house to home and all of a sudden i get a cop pulling me over saying i ran a red light and was going 80mph!

at court cops say he saw a BROWN vehicle was moving at a high rate of speed and ran a red light and go 80mph on another road and then gave me a ticket. said i said i kept complaing to call my mother cause i had to go home or i would get into trouble.

my story:tell him im on 2 pain killers and a muscle relaxer from accident 2 days ago my speech is slurred. coming from GF house going 35 go slow up to the light to make it change quicker and then turn left and go 45 the rest of the way. ticket say my car is a BROWN 88 Toyota CAMERY 2-door:nono:. i tell them that my car is a RED 87 Toyota supra 2 door! also tell him why did it take him 2 miles to pull me over? was he doubting whether i was speeding and ran the light? did he think it was another car? i draw a diagram and ask him at what point did you see my car? points to the section of road towards the ocean. i then tell the judge i looked in my rear view half way through the road and saw him turn right passenger side facing the curb. now thats the opposite direction!!! i then tell him you can NOT see the intersection until 2/10 of a mile comming from salinas. i was half way throught the road when he made that turn so of course he sped up to catch up to me. i told the judge aslo that i can be out as late as i want as long as i tell my parent where and when im going to be somewhere and i was in no rush

GREEN: point cop said he saw me and persued
PURPLE: point he was at when i saw him turn in rear view passenger side to curb
GREY: point you can see the intersection from
RED: point i was when i saw point PURPLE
YELLOW: point he pulled me over in next city

Total distance GREEN to YELLOW about 2-2.5 miles.

judge said im guilty of both and reduced it from 800 to 500 what should i do? how is this possible?

Your lucky he did bust your ass for DWI. Being under the influence of precription meds,or over the counter meds and they call haul you in. Consider yourself lucky

As for the rest,you should have went in with a lawyer

No i think he was on pain killers while at court not while driving.

If the wrote down a brown camry on the ticket why are you paying for driving a different car? Do you or your mom or dad own a brown camry?

Is there any way to file a law suit against cop and judge for this?

Wrong car on ticket means it should have been thrown out, hence lawyer. And no, paying the ticket is not cheaper most of the time, especially if it goes on your record and causes your insurance to go up...

And depending on what field you work in could hurt you there too. As speeding tickets stay on your record for 3 years.

only thing that was correct was the license plate. There where multiple questionable things and i thought the judge would have thrown it out for that. the cop was getting heated when i called him out and i was just calm and respectful. in fact i have not driven on that road for 6 months because of this ticket.

Not necessarily. I tried this after a speeding ticket where they got some of the details wrong and unfortunately this is not cause to get a ticket tossed. There are certain details that are immaterial to the case and car color/make/model/year are some of them. Yes its annoying but its really not material (especially at night) if he saw a dark car thats 2 doors driving fast.

yep hes right....how much is the ticket..?

i would fight it...with lawyer sepically if your young...i got a dui and full coverage insurance for me is like a morgatage....so i would defiently try and get a lwayer 1 appaeracne 2 court would probably be around 300-500 and it would be better than paying the same price in a ticket and beong on your record...

and i would file complaint against the officer even though probably wont do anything do it anyways

What you should have done is gotten a lawyer.

I drive my cars like I stole them. I have a clean license. Why? Because I'm a smooth talker? Because I'm such a nice guy? No.

Because I always hire a lawyer, and I always instruct them to plead it down to "lesser offenses" (i.e. - equipment and non-moving violations). This gives the solicitor/prosecutor a high conviction rate and keeps the money flowing to the ugly monster of government. It sucks, but it placates the beast and gets his teeth off of your nuts.

It's been a long time since I've actually gotten a ticket (older and wiser and all that crap I guess), but fighting a ticket without a lawyer is a crap shoot at best. Either pay it, or pay a lawyer to fight it. Trying to do it yourself rarely works out.

Want to know why?

Because these judges, lawyers, prosecutors and cops work together every day. They have a professional relationship. Sometimes, on top of it, they have personal relationship as well. Maybe their kids go to school together, maybe their spouses are friends. For all you know, the prosecutor had dinner at the judges house last night. Odds are they all run in the same social circles. All of that adds up to the fact that even 100% honest people are going to tend to believe people they know before a stranger. And who are you? You're the stranger. Ever had a ticket before? Any problems with the law? If so, now you're a stranger who is a known problem, they've got even more reason to not believe you.

Odds are they are viewing you as some punk ass kid they don't know driving what (to them) appears to be an old piece of crap rice rocket, speeding around and being irresponsible. One of their own, the cop, who they know and trust, says he saw you do it. You say that isn't true. They don't believe you.

It's not "right" but it is how it is. You need someone who is a part of their club to represent you. You need someone who would have known that he could plead this charge down with the solicitor before you went to court. You need someone who not only knows the system, but is a part of the system. You're an outsider.

Now you're convicted and your options are limited:

Go talk to a lawyer and see if he can salvage the mess you've created. If he thinks there's a reasonable case of overturning it for less money than the fines will cost you, hire him and file an appeal. Otherwise suck it up and just pay the fine.

You gotta fight every ticket you get. Period.

For me 80mph just about anywhere, in any vehicle would be a career-ender.

I know, I know, you dont drive a truck. its not the only place that works. Many, many moons ago, i wanted to be a car salesman. Strange ambition maybe, but i loved cars, and have a natural talent for sales.(easiest money i ever made was slinging kirbys door-to-door!) Hell, if i won the lotto today, i'd be just a dumbshit lot-porter somewhere. It's what i wanted to do.

Had to put it off for three years because of tickets. With just two speeding tickets, i was un-insurable for the dealership. There are other occupations im sure where this can really matter.

Besides, those insurance premiums suck if your record isn't clean. I enjoy having those$300 a year rates, in spite of having a jeep on the policy!

Lawyer up, go for the appeal. It is worth every penny. Hell, its a big enough deal to me that i use a pre-pay legal service. Just fighting one bs ticket that would have cost me my gig is well worth the couple hundred a year for several years! It has saved me prolly a couple hundred grand in lost income potential had the ticket stuck.


And mike, around here they call that social networking in the legal community "home cookin'". lol, during my divorce, the lawyer did a lot of this! they spent more time bsing in the judges office than in the courtroom. Her nervous-looking rookie lawyer was baffled and confused as to what was going on.....cant help but think this would have been useful had i decided not to settle....

I found out that around here the car info is strictly for statistics. Aslong as the drivers licence number and info is correct, ticket stands
