accident... need help/info.

i was driving my beater around and this guy missed a yield sign at a intersection and i hit him. he was clearly at fault. he has no insurance and only a driving permit. I only have liability on it and paid onlyh $1500 for it, but i'd still like to have something for it. the police officer told me to file a claim with my insurance and they'll go after the guy for me, which i dont think that's part of their job is it? what are my options here?

I thought that without collision you are not covered in the event of an accident and must pay yourself. You said you only have liability, which covers them. He has no insurrance, so you're toast.

Police must take a report whenever damages exceed a certain amount (limits vary by state, so check local laws). Also, I hope you took all his info down, because if he tries to screw you over, you're gonna have to sue him in court, since you only had liability. Have your damages appraised in writing by at least three reputable body shops. Negotiate a settlement with the guy. If he balks, sue him civilly in court. When/if you end up sueing him, you should include court costs, verifiable loss of earnings, your hourly wage times hours needed to prepare your suit, car rental if needed, in addition to your damages, as verified by the shop estimates. Easy as shooting fish in a barrel. And no, your insurance co. won't care your car got damaged, as you only had liability. Good luck.

I've only got liability but pay a little extra for uninsured motorist coverage so if I get in an accident and the other person doesn't have insurance, my company covers the loss and goes after the other person in court. It's a great feature, I've had to use it twice. I'd recommend checking w/ your insurance company and see if you have this benefit and if you don't see if you can get it to cover any future incidents like this.

umm dont you legally have to have insurance? this problem seems so common in the states, yet i have never heard of once someone driving around in BC without insurance and getting in an accident.

If they don't want to pay for them, they run fake or stolen ones. I live in TX, right by mexico, ya know. A lot of illegals (and Americans for that matter)driving around with no licence, insurance, you name it. It's kinda scarry, way too lenient on crime. And if the illegals cause an accident you can forget any kind of compensation, they basically have more rights than I do. Don't get me wrong I don't hate that they are trying to do better for themselves, Its just all F'd up in the states with the laws. I see more regular honest people getting in trouble for stupid little crap than out right law breakers.

I live in B.C too, I know of people who drive without insurance, without licenses, you name it. People do it everywhere.

ya sure people do it here, ut not to the extent i hear about in the states.

like sure people weill drive when they got ther liscence suspended if they think it was unfair, but people who cant afford insurance but still want to drive dont just stick a stolen plate on and call it done and drive around every day ho hum like its no big deal, at least nobody i have ever heard of dos that. and if i knew of anybody who did that, i would crash into their car on purpose and make it seem like it was there fault :p

be wary you're use of the word HICK

beyond that in Va to get a license plate you simply sign a line that says "i hereby do verify that this vehicle is insured"

they don't actually check it.

go figure.

^ I think it's real similar if not downright the same here in NM. Or they get an insurance policy just long enough to get the car registered and then let the policy lapse and hope they don't get in any accidents or get stopped in the mean time. It's like a $300 fine to drive w/o insurance here.

Yeah, I have no doubt people are people, no matter where you live. If you can get by with doing something, people will do it, and think that its "right" as long as they don't get caught. It just seems more out of hand here in the states, but I really wouldn't know. And there seems to be more loop holes here for criminals.

ok well here you get your liscence plate when you get insurance.. if it expires, you could still keep driving but sooner or later the cops are gonna pull you over for expired tags...

and in regards to my use of the word hick, its not meant to insult anyone here that is american, i use it to describe the kinds of people who would drive aroun without insurance, shooting guns in public, etc etc all the crazy stuff i hear about you down south.

In my neck of the woods (erm desert...high plains...uh whatever...) the people running around shooting guns off in public we don't call hicks...we call them thugs...or "gangsta's" or just plain stupid. Definitely not hicks though. ;)
